No, because again, the number does not matter. A state actor must endeavor to eradicate a "substantial" number of a protected group in order to destroy it. So that means that if one attempts to destroy a substantial number of members of that group, and only manages to kill 3, they might still be liable for genocide given the intent to destroy. On the other hand, if a large number of people are killed, that is not genocide without the intent to destroy. You cannot reverse engineer an accusation of genocide based on numbers alone.
