In a normal world, this would be thrown out for lack of standing, but the Texas legislature has created standing by statute. These types of standing statutes often get tossed. Lujan v. Defenders of Wildlife is one example of the Supreme Court articulating the proper standards for standing; but that was at least 20 years ago, so not sure how or if the law has changed much on that.
