If Diego Rivera had a storefront or perhaps a website that said "murals for sale" and someone wrote asked him to do a pro-capitalist mural, according to Sotomayor he could obviously decline. ,

However, if Diego Rivera had a storefront or a website that said "Prom murals for sale - ask someone to the prom with a mural!" and a young woman came in and said, "I want to ask my girlfriend to the prom via a mural," according to Sotomayor he could not decline if he is providing the same service -- in this case a prom invitation -- to a young man asking a young woman.

That's the difference.

And no, I wouldn't take Smith's case. Not because of her religion, but because of what she claims her religion compels her to do -- in this case discriminate. Just like I wouldn't take a case of someone who believed that women should be subjugated to men, based on "religion."
