I don't know that the Supreme Court will "not be able to kick it back on a technicality." I think that's exactly what they will use to decide a case regarding the S.B. 8 - and they likely won't rule on the question of abortion itself. In the meantime, clinics and providers ARE shuttering. And because of the way the law is drafted (the state doesn't enforce it) it will take much longer to wind its way through the federal courts.

Luckily, it seems the state courts are stepping up.
